Acceptance of Terms

By visiting our website at highpointdecks.com or engaging our services, you agree to these Terms and Conditions in full. If you do not agree, please do not use our website or engage our services. Advanced High Point Decks reserves the right to update these terms at any time. Continued use of our site or services after changes are posted constitutes acceptance of the revised terms.

Description of Services

Advanced High Point Decks provides residential outdoor construction services, including but not limited to custom deck design and build, composite and wood deck installation, deck repair and replacement, fence installation, pergola installation, screened porches, covered decks, and related outdoor structures. Services are provided in High Point, NC and surrounding communities in North Carolina. We reserve the right to decline any project at our discretion.

Estimates and Pricing

Estimates provided by Advanced High Point Decks are based on information available at the time of the site visit and written quote. All estimates are subject to the following:

• Estimates are valid for 30 days from the date of issuance unless otherwise stated in writing.
• Final pricing is confirmed in the signed contract. The estimate is not a binding contract until both parties sign.
• Unforeseen site conditions discovered during construction - such as rotted framing, compromised structural members, or buried obstructions - may require a change order with additional costs. We will notify you and obtain your written approval before proceeding with any work outside the original scope.
• Material prices are subject to market fluctuation. If there is a significant change in material costs between estimate and project start, we will notify you in writing before proceeding.

Scheduling and Cancellation

Project scheduling is confirmed in the signed contract. The following terms apply:

• Start dates are subject to permit approval timelines, material availability, and weather conditions.
• We reserve the right to reschedule due to weather or other conditions outside our control. We will notify you as promptly as possible in such cases.
• If you need to cancel a project after signing a contract, any non-refundable deposit paid will not be returned, as it covers project preparation, material ordering, and scheduling costs.
• Cancellation of a project after material delivery has begun may result in additional restocking or return fees, which you agree to cover.

Payment Terms

Payment schedules are outlined in the signed project contract. Standard terms include:

• A deposit is required upon contract signing to secure your project start date and initiate material ordering.
• Progress payments may be required at defined project milestones as specified in the contract.
• Final payment is due upon project completion and before final walkthrough sign-off.
• Invoices not paid within the timeframe specified in the contract may be subject to a late fee as outlined in that contract.
• We reserve the right to suspend work on any project where payment obligations have not been met.

Permits and Inspections

For all applicable projects, Advanced High Point Decks will apply for required building permits on your behalf as part of the project scope. Permit fees are either included in the contract price or billed separately as noted in the contract. Project timelines are subject to permit office review periods, which are outside our control. The homeowner is responsible for ensuring that any applicable HOA approvals are obtained before work begins. Advanced High Point Decks is not responsible for delays resulting from HOA review periods.

Homeowner Responsibilities

You agree to:

• Provide accurate information about your property, including any known structural issues, utility locations, or HOA restrictions.
• Ensure the work area is accessible and free of obstructions before the project start date.
• Notify us in writing of any known underground utilities, septic systems, or other subsurface features in the work area.
• Be available for communication during the project for decisions or approvals that arise.

Warranty Disclaimer

Advanced High Point Decks warrants our workmanship against defects in construction for a period specified in your individual project contract. This warranty covers defects resulting from improper installation.

This warranty does not cover:

• Normal wear and tear from weather and use
• Damage caused by improper maintenance, neglect, or modifications made by any party other than Advanced High Point Decks
• Damage caused by acts of nature, including storms, flooding, or extreme temperature events
• Material defects, which are covered by the respective manufacturer's warranty

Except as expressly stated in your project contract, all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, are disclaimed to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by applicable law, Advanced High Point Decks shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services, including but not limited to loss of use, loss of revenue, or property damage beyond the scope of our direct work. Our total liability for any claim related to a project shall not exceed the total amount paid by you under the applicable contract.

The content on this website is provided for general informational purposes only. We make no representations or warranties about the completeness or accuracy of the content. We reserve the right to modify or remove website content at any time without notice. You may not copy, reproduce, or distribute website content without our written permission.

Dispute Resolution

If a dispute arises between you and Advanced High Point Decks related to our services, we encourage you to contact us first so we can work toward a resolution directly. If we are unable to resolve the dispute informally, both parties agree to attempt mediation before pursuing litigation. Any legal proceedings that cannot be resolved through mediation shall be brought in the appropriate courts of North Carolina.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in North Carolina.

Modifications to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes take effect when posted to this page with an updated effective date.
